Expert Witness Services

OTConsulting provides expert witness services to assist in litigation by reviewing cases, provide an expert opinion, serve in a deposition or testify in court to settle disputes in the healthcare imaging and IT field. OTConsulting participated in several legal cases supporting either the plaintiff or defendant including:

  • A hospital disputed whether a PACS vendor met all the requirements as specified in its RFP resulting in the vendor having to restitute their payments and de-install the equipment.
  • A vendor disputed whether a contract was correctly awarded based on their specifications, resulting in a rebidding process.
  • A hospital claimed equipment failure which prevented a radiologist from correctly diagnosing a patient, who passed away. Review of the audit trails revealed that the radiologist did access the images for review and there was no software failure.
  • Poor integration between a radiation planning system and LINAC caused patients to be radiated incorrectly and subsequently become paralyzed.
  • A PACS vendor was incorrectly accused of NOT providing certain requirements and did NOT owe a restitution.
